Is download jav torrent safe?

Well, I moved to US 3 months ago. My cousin was caught when he download a US movie via torrent and he had to pay a fine. But I have downloaded jav torrent several times before and nothing happen.
I use akiba-online torrent and javjunkies ( they are public tracker, right?)
So, am I just lucky? Or I will be ok if I don't download US stuff?

When you talk about your cousin getting caught, I can assume this was for a mainstream movie.

As far as I can tell, the copyright lobbies are not really concerned about pornographic material. It is even more safe for you to download JAV, it is material licensed in Japan, not in USA. Well the censored videos at least.
