I think we can start with the fact (I don't have official proof/poll results etc., but I think it's safe to assume) that most people don't consider this a serious crime, considering that 1) in general, these companies can make ends meet or even thrive with the current amount of piracy, and 2) if it's a niche studio, then it will be sad to see them go, but no one is really irreplaceable (and it's a good thing, actually; like, I was infatuated with Kaho, but thank God I'm over it somehow, partially thanks to there being so many other huge-titted girls... there won't ever be anyone like her, really, but I can find JAV replacements), and 3) JAV, as any porn, is a frowned-upon etc. industry (same as prostitution, even though it's been around since humanity has been around), meaning that it's a grey area, and JAV makers by definition will never achieve the same level of empathy as miners, teachers, doctors, etc.
I mean, my view is this: porn, prostitution etc. is a necessary evil since not everyone has the resources (be it looks, time, etc.) to build a stable satisfying relationship (and/or they might just not want to, but I think a lot of us can agree that from the evolutionary standpoint, we need to form stable families to survive — and we have been so hard-wired to be social and family-based that if we don't follow that pattern, we cannot really be satisfied with our life, hence all the replacements, including picking up a new girl every night, etc.). Porn (including JAV) and various form of prostitution (including compensated dating, papa-katsu, whatever you wanna call it) are replacements for this literally indispensable part of human life and thus, from the societal point of view, deserve, at best, turning the blind eye, and at "worst", total prohibition (though we all know that prohibition of this stuff will not make it go away, ever)
So, I find this an interesting case: people who make content that is deemed anti-social in some deeply-engrained way demand justice and protection from the same people who they leech off of (using their inability to form stable relationships for their own gain). This is really a can of worms, and I'm just watching from aside, grinning inside
Like, imagine JAV disappeared — AND, at the same time, the government launched programs that would help people in it to find other jobs so that they don't have to resort to "delivery health" etc. — AND, at the same time, the government made it their policy to ensure that people are more likely to form stable relationships... Yeah, like that would happen anytime soon, even in Japan. So, it's just a sad show, because in this case, just by scratching the surface via this anti-piracy thing, and not addressing the underlying cause for the existence of JAV and piracy, for now, everyone loses*, whatever the outcome is
* If JAV continues making profits, we will likely continue to see ruined lives of actresses as it's a (hypocritically) frowned-upon profession; porn cannot really die way, it might just become niche, which might be a better thing actually; piracy will never go away; people who are not fit to form stable relationships will never go away... So, yeah, it even appears that the downfall of the way the things are now (and stagnating, I feel) in JAV is desired. Just to see what else could work: we might be missing the new golden age just because we let those mastodons continue supporting the old ways
