I have seen no mention of this issue in English speaking circles, so I thought I would bring this to everyones attention here. The Japanese Diet (Japanese Congress/Parliament) Recently enacted a new law that regulates the AV industry. Here is a summary of what the law entails written up by someone else who took the time to get some of the major points.

  • 1. The target of this bill is not only actresses, but also all the people who appear, regardless of age and gender
  • 2. The film company needs to provide a performance contract before filming. The film company is responsible for explaining the content of the filming to the performers in detail, and also needs to protect the filming safety of the performers
  • 3. After signing the contract, filming and related follow-up work can only be performed after the specified time: - The filming can be carried out only after 1 month of the signing of the filming contract. This month can be understood as a cooling-off period - The finished works, including the announcement of the work information, pre-sale, and official sales, can only be officially started 4 months after the shooting - Before the product is launched, the participating performers need to confirm the content of the film
  • 4. If the above rules are violated, the performers have the right to unconditionally terminate the contract
  • 5. All AV performance contracts can be unconditionally terminated one year after the AV work is announced, including removing the title from sale. In the first two years of the legislation coming into force, this period will be two years.
  • 6. Actors who appear in AV do not need to bear any compensation costs arising from the termination of the contract
This law puts a lot more regulatory burden on JAV companies. Mainstream JAV already has this thing organization IPPA from what I understand is what they use to self regulate. Thats the IPPA symbol you see in the top right corner in a lot of JAV these days. It means the movie was made properly and is a stamp of "approval". The problem with this law is that it puts criminal penalties, like fines and even Jail time. So the making of JAV has become a bit more risky, especially since everybody including male actors can cancel a movie.

Now I don't speak Japanese, So I don't know how everything is shaking out but it sounds really bad for JAV. If anyone has any more information or actual happenings in the JAV industry relating to this it would be nice for you to share.

This law was enacted just this last week, so there is a lot of unknowns happening. According to this Actress, all JAV shooting planned for July has been cancelled.

Honestly, I see the industry retreating some from panic mode in the not too distant future. Delistings still are quite rare and this law probably won't change things. It's more likely than not it will not be much enforced. Japan won't become like Korea because there is no fundemanetal Christian base. If anything, it seems like Korea's views on porn are softening as of late.

Per AiU, she is an attention-seeking hypocrite and is best ignored.

I can get behind any legislation that protects the rights of workers.
There already are a multitude of laws in Japan protecting worker rights. This goes above and beyond and pretty much makes any person who appears in front of the camera a god. As others have noted, if one performer on a whim can tank a title, it would be increasingly risky to hire new faces. Whether this would lead to less mainstream JAV is TBD. I think it’s possible those dead-set on performing, but have faced initial rejections due to the law would first build a career of sorts in Doujin/UC JAV (because it's not like anyone shooting in these sub-industries--especially UC!--are going to be strictly complying (if at all) with the new law) and use that as part of their resume to enter mainstream.

Honestly.....the law looks good on paper......but in reality IMHO it's gonna be toothless.....and it looks like it targets censored porn...

Japan has a whole bunch of labor laws that supposedly protect workers...but no one follows them...

For example: there are laws that supposed to cap OT hours...but companies and workers ignore it, workers don't log the extra hours or they come in extra early....

There are laws to that supposedly grant paternity leave...but there's a stigma if you take it and can hurt your profession later on as the company will see that you are not prioritizing work

There are laws supposedly to protect foreign interns..but Japanese companies treat them like cheap labor

Fuzoku business would have disappeared if Japanese laws were followed

Either business as usual OR porn will go underground OR the yaks will find a way around it

I agree fully. Not sure why some here is getting upset.
Honestly I just find it funny that it's men who again, is making an educated guess on what is and isn't right for women, and how they don't have to worry because nothing will change and they are safe.:hehe:

So far I don't see a bunch of actresses asking for their movies and videos to be cancelled. So I think it shows that women in the industry aren't as vindictive like those who run the studios or behind the camera.

If the studios have to change formats, so be it. Honestly, the industry been lazy for years, relying on the same old formats for years. Maybe this will make them more creative, which the AV industry is known for.

Laws are laws and are constantly changing. The notion that it's the poor studios who will suffer is ironic considering it's always been them who did the exploiting lol
If they get f*** in the ass, then so be it. They're not suffering by any means hahaha

For those who actually worked in the industry and gave it attention, someone like Ai Uehara(who was also exploited), her views and experience will always take credence over a bunch of upset fappers, affiliates, and keyboard einsteins lol

I'm sure this post will upset some, even if that wasn't the intention, but so be it:haha:

Exploitation is a key component of capitalism especially in Japan.

Let me tell you about young high school girls…..

Companies often recruit high school graduates (a) cheap labor (b) they marry a full-time male worker. Win-win situation.

I’ve had students enter big companies, but later on I find out that student is pregnant or married after a year or two.

Another big company I taught at only hired ex, amateur models, athletes for their OLs in the hope that they’ll marry the full-time male employees

It’s not only the porn industry that exploits its workers.

This law is another perfect example of Japan overreacting and over-regulating

On a side note: make more uncensored porn so the law won’t apply to it!!

Men have the same right to opine on things as women do - just as women can (and almost never shut up about) things that mainly affect or involve men; such as female lawmakers who make laws for industries where there's hardly a woman in sight. If we followed your logic women wouldn't even be in politics because most politicians are men.
Yes men can share opinions... but a man will never know what is and isn't good for woman. And men and women in the sex industry have difference experiences.

lol what? Ai Uehara got out of debts from loan sharks and saved enough money to last a lifetime with her work. She was not exploited. She could have stopped making porn at any time and worked elsewhere. But she didn't because she likes getting fucked, as is evidenced by every one of her videos. You can tell when the actresses are and are not enjoying the sex, and Ai Uehara basically got to do her hobby for a living. The other reason she didn't quit early and find othe rwork is because she's probably too lazy to do other work that takes physical labor or long hours, etc etc that every other working woman has to do. I guarantee you Ai didn't want to spend her time at a combini stocking aisles, cleaning up patients at a hospital, working at a construction site and she sure as hell wasn't going to get a professional degree and work in medicine or law or engineering. There are certainly women (and men) that get scammed in the sex industry, but a long time veteran who spent years on the front window of every sex shop in the country knew exactly what she was doing - she is not a child.
Anyways, she was exploited and people wasn't paying her worth and keeping the rest. She got fed up, got wise and decided not o be a victim of the sahdy business practices of the industry. Good for her.

Further proof that she can't make it outside the "my looks sell" category is that her current businesses now that she may have blown through ehr cash is thotthing on youtube, opening a male-oriented barbershop where she gets other younger girls to cut men's hair while her face and name attract them to the barbershop (in your logic, Ai is now exploiting younger girls for money), and doing fiverr type of work where she says happy birthday for a couple man-yen.

The elephant in the room is DMM taking a whopping 70% cut on average that this law will do nothing to change. Studios pay as much as they're able to. They're not making bank. Agencies take around 50% which is a big cut of actress pay, but they do take care of almost every single need of the actress both work and personal if needed. There's also nothing really stopping an actress with desire and smarts to open her own agency (because you really only need one person) and so long as she follows IPPA rules, she'll be in fine shape.

Some in this thread (not you, GP), think this law will help ease exploitation and give performers more power, but the former doesn't exist in mainstream JAV. Thanks to AV Jinken, we have numbers to back this up without having to rely on sensationalist and potentially apocryphal anecdotes. Performer power? Women on set are treating as goddesses, paid quite well for a day's work, and (up till the law was passed) had the ability to request delisting after 5 years. Mind you, these are adults entering into clearly worded contracts (I have the templates) by their own free will.

This law will do absolutely NOTHING it has set out to 'fix'. Mainstream JAV is already heavily self-regulated and well-oiled and Doujin/UC creators certainly will continue to operate under the radar when it comes to this type of legal compliance.
And maybe producers will finally recognize the true value of proven talent and compensate them accordingly.

I fully agree, the way the AV industry is set up is very bureaucratic and retarded with all the involvement of companies, agencies, manufacturers and the fact that they still produce and depend on DVD sales to a large degree. The majority of Japanese websites I have visited look like they were designed in the early 2000s. I don't know if that is just from overall lack of web design or just the nature of the bulky awkward kanji. Is this why they still cater to DVD? Anyway, that was a little bit of a tangent.

As has been pointed out already. The major "issues" this law propses to fix already have laws on the books for victims to use when those terrible situations ever arise. The road to hell is paved with good intentions and what this law does is just makes it more difficult for law abiding people to make porn in general. This law just adds more layers of bureaucratic bullshit that will make it difficult for performers to actually work for self described "legitimate" and "proper AV" companies. Only naive people think that intrusive, ham fisted, not well planned out, regulatory restrictions like this are productive and will actually stop bad things from happening.

The whole idea that you have to sign a contract and wait an entire month, pray you don't catch an illness before your shoot or get injured, then You do the job, but then technically one person involved in the movie could pull the entire rug out of the project and fuck you over simply because they can't be held to account for their own decisions. The hoops and bullshit performers and companies alike have to jump through to just to fuck on camera will just turn more away from working for "legitimate" AV companies. If this law just applied to 18 and 19 year olds that would be somewhat reasonable, but in my opinion an adult is an adult or they are not. This law treats every adult as if they were a giant retard baby like the movie I am Sam. If I was a "proper AV" company I would ditch the toothless IPPA organization. change identities and just set up a corporate entitty in Chatsworth then go on business as usual. And If I was a performer I'd go work for these companies that will allow me to work and get paid in a timely fucking manner.

I mean those against the "new law" say it won't work... so why get your blood pressure up? You shouldn't be worry about it.

Honestly, if you're not in the industry as the main ones(studio boss, execs, managers, producers, contracters, directors, actresses, actors, etc) than this will has little to no effect on your life lol

Just watch your porn and stress over something that actually concern your life haha

If you don't care about anything why are you in this thread? Do you have a counter to my argument that this law does more overall harm than good? If you really don't care about the topic then I probably shouldn't even engage with you because that would make this a pointless conversation to have.

The reason I care about this subject is because laws like this that are passed willy nilly should be condemned. It's entirely possible that the big DMM monopoly could adapt to this law in such a manner they could easily create an even bigger monopoly than they already have. If it becomes harder to make JAV titles there is going to be less mainstream AV work. Less demand for actresses, therefore this doesn't help actresses because of supply and demand. They will pick the actresses who will do more for less. Which would do the opposite of what you indicated your desired outcome was in your previous posts. Alternatively, Actresses could choose to do underground AV that don't follow IPPA regulations to begin with let alone the law. So how is this law protecting Actresses in that scenario?

The people who made this law would rather porn not even exist. To you only weirdos would be upset that there is no porn. So that begs the question why are you on Akiba-Online? If this conversation is too autistic for you then you should consider moving on.

Obviously the world continues no matter what happens. I don't understand the point of that question. You have established that its not a big deal to you and you don't care and you imply that I shouldn't either. Duly noted, but I don't agree because this law effects real life people and peoples livelyhoods in a negative way and all kinds of laws can have this effect when implemented poorly. On the subject of "Ai Uehara exploited" - I was not aware she cause some stir. Did she request for some/all of her videos to be removed? Is that why I see only 30 titles with her on Fanza?

And if so, she did not remove two of her Gokkun-only titles at S.P.C.?

Does that mean she is ok with those productions or that studio? Anyone knows? May @Gokkun Punch?
