Yep very good question. I already hinted it's a rather curious arrangement when I said it's not all money.
Compensation is for ... emotional stress? breach of contract? breach of trust? breach of faith? Loss of future (but illegal) contracts? Pretty much anything EXCEPT drop in sale numbers. Because sales is not of concern to idols, only for studios and retailers.
I think logically and legally the studios can easily say no to compensation. It would be hard for the idols to prove that studios were careless to the extent that they are liable to compensate for idol's loss, and to prove idol's loss is financial. But it's Japan, what hard logic and black and white laws say is just for reference.
You are right, but the reality is FC2 is thriving with daily new uncensored materials and Caribbean etc are struggling and re-releasing their years-old vids and new vids mostly starring old and crusty idols. FC2 products isn't better, but their business model is seriously disrupting old uncensored industry.
It's also easier and a bigger target for gov to crack down on uncensored industry than to go after 2-3 person fly-by-night operation making and selling FC2 vids.
Without having read any, I'm willing to bet uncensored footage being leaked/published is a serious breach of contract for any performer's deal with the studios, for which they may seek compensation.
It puts them in the spotlight again. A lot of the Prestige girls have retired or were about to retire.
I guess the hope is you put your head down, don't make headlines and people will forget about you. The uncensored leak puts a damper on that plan. Probably worse for those SOD girls who had their identification leaked.
