アダルトビデオ(AV)への出演を強要されたと訴える人が相次いでいる問題で、毎日新聞は、AV女優が所属するプロダクションの団体が今春の全面導入を目指している統一契約書を入手した。出演意思確認の徹底に加えて「女優は理由なく仕事を断れる」「撮影キャンセル時に生じた損害は女優本人に賠償させない」などと定めており、団体は「出演者の人権や自己決定権を重視した」としている。
これまで、AV出演について触れられていない、もしくはAVであることがわかりにくい内容の契約書が問題視されてきた。統一契約書には「ヌード撮影、性行為を伴うAV撮影」と明記され、出演者は「何ら強制・欺罔(ぎもう)されることなく自らの意思で決意した」と認めた上で署名することになる。既に一部のプロダクションで使用を始めている。
また、ギャラの“透明化”に踏み込んでいるのも特徴だ。AV業界では、女優が実際に受け取る額=(1)とAV制作会社からプロダクションに支払われる額=(2)の比率などを開示しないのが通例とされてきたが、統一契約書では「(1)は(2)の〇〇%を下回ってはならない(※〇〇の数値はプロダクションが個別に設定)」「女優は(1)の根拠となる資料の開示を求められる」などとした。
そのほか、撮影キャンセル時だけでなく、撮影後に女優が作品の販売・レンタル・配信停止を求めた際も本人に賠償請求しないことなどを盛り込んだ。
AV女優のプロダクションを束ねる業界団体は存在しない状態が続いていたが、出演強要の社会問題化を受けて昨年4月に「日本プロダクション協会(JPG)」が発足。有識者らによる第三者委員会「AV人権倫理機構」の監修を受けながら、契約のあり方を見直してきた。JPGには今月15日現在、大小の25社が加盟しており、4月から統一契約書を全社で導入する予定。ただ、基幹部分は統一しつつ、各プロダクションの事情に応じて個別に規定を設けることも認める方針だという。

Manichi got a template of the "unified contract" that is to roll out in April and they pointed out some of the more interesting clauses.
1}"The actress can refuse the job without giving explicit reasons"
2) "No compensation is required from the actress if she turn down the shooting or demand her works to be withdrawn after the shooting"
3)"Percentage of the production fee that is given to the actress as wage to be stated"

I can't read japanese but I will just say, the jav industry is not unified, so this "contract", I really doubt Hokuto or SOD would let the actresses have more power over them, so i doubt they'll join in on this, and if the top dogs don't join in then it really won't do much

it depends, if Hokuto and SOD(who are 70% of the industry) aren't in it well they control most of the well paying jobs, you can go make less money doing probably more work, or deal with a little explotitiveness but make waaay more money. Those to companies will always find girls willing to work, and pay them good money, i'm just saying this contract stuff doesn't work without them.Also, As i've been saying this hypothetical contract gives the girls way too much power, and people will all the power don't like giving up most of there power So I don't think they'd joinThe report didn't go into specifics. But would you work for a company that offer better rights and privileges with a lower pay over one that offers higher wage but is known to be very exploitative ?
Mainichi isn't some bullshit rag. If they made such a report on their print edition, a lot of idols and prospects will have the expectation that it IS the industry standard practice. But the contract as printed in the article is clearly very one-sided. The industry may go out of business if majority of performers have such one-sided contract in their hands. So I can think up at least 3 different scenarios how it could develop... (1) since the performer has the power to call off a release even after the studio invested real money on production, the industry can shift the performer's income to kick in only after a vid has generated income. I.e. old ways: industry pays performed an amount, and invest in production and finally pocket the profit or swallow the loss. New ways: performer gets almost nothing up front, she makes the vid, after industry make profit from the sales, she gets a share of the profit. This may be the more reasonable way. Performer still have the control, but she gets no pay if she pulls the plug.
(2) industry work with yakuza to "discourage" performers who call off releases or withdraw her past vids without reasonable cause.
(3) industry and performers signs some side contract that weakens the pro-performer clauses of the standard contract.

Shunka Ayami posted her thoughts on the "Compelled to shoot AV" mess. It's not too easy to full understand every words but the general idea is perfectly clear: her own personal experience in AV has nothing in common with those who accuse the industry of coercion. Her first sentence was kinda gingerly doubting the words of the victims, then she wrote several sentences that said the same thing in multiple ways: that her whole AV career she herself decides everything, she was in control the whole time. It's not the first time Shunka Ayami had stated support for the agencies.
Earlier AIKA supposedly post comments to generally the same effect but in even stronger words. I don't think either Shunka or AIKA are directly calling the accusers/victims liars, but they are saying "I was never coerced, and I have not seen any girls been coerced". Shunka's post seems to imply what she's thinking. "Well I have a robust personality and can deal with life. Those girls who accuse industry of coercion, perhaps they have that kind of weak personality that is fated to be abused and exploited by bad people"
Quite a lot seem to be dynamic with Shunka nowadays.
